PENEGAKAN HUKUM TERHADAP PELANGGARAN HAK ASASI MANUSIA DALAM PROSES PENYIDIKAN

Abstract

One of the characteristics of the law state is the protection of human rights. The protection of human rights is carried out by the state through the tools of state equipment. The Police of the Republic of Indonesia (Polri) is one of the tools of the state by persons who are given the duty, and authority to guarantee the fulfillment of human rights. This study aims to examine factors that cause human rights violations in the process of criminal investigation and law enforcement of human rights violation. This is a normative research design using secondary data, and primary data by interviewing resource person. The method used is literature study and interview. As a result,the occurance of human rights violations in the investigation processcaused by many things such as lack of understanding of police officer against police ethics code and lack of professionalism of police in carrying out their duties.
