Pengaturan Hak Cipta Komunal Atas Seni Tabuh Sakral Di Desa Adat Blahkiuh Dengan Hukum Adat

Tabuh art is one of the traditional cultural expressions of the Balinese community that embodies cultural, religious, and communal values passed down from generation to generation. As part of communal intellectual property, tabuh art requires legal protection through collective copyright to prevent misuse or exploitation by unauthorized parties. Although the protection of traditional cultural expressions has been regulated under Law Number 28 of 2014 on Copyright and the legal status of Desa Adat has been recognized under Bali Provincial Regulation Number 4 of 2019 concerning Traditional Villages in Bali, its implementation in Blahkiuh Traditional Village has not yet been optimal. This study aims to examine the form of collective copyright regulation for tabuh art based on customary law (awig-awig/pararem) and to analyze the role of Blahkiuh Traditional Village as a legal subject in regulating the collective copyright of tabuh art. This research employs an empirical legal research method using statutory, conceptual, and sociological approaches. Data were collected through library research and interviews and analyzed descriptively using a qualitative method. The findings indicate that Blahkiuh Traditional Village has not yet established specific awig-awig or pararem governing the collective copyright of tabuh art. The role of the traditional village remains focused on preserving and fostering tabuh art, while legal protection through collective copyright has not been implemented optimally. Therefore, clearer customary regulations are needed to ensure effective legal protection of the collective copyright of tabuh art.
