Proses Penyidikan Terhadap Pelaku Tindak Pidana Pencurian Sepeda Motor Dengan Pemberatan di Wilayah Hukum Polsek Kuta Utara Polres Badung

Abstract

The problem of aggravated motorcycle theft is a criminal act that often causes unrest in the community, including in the North Kuta Police area. In handling it, the police take legal action in disclosing and carrying out an investigative mechanism so that the perpetrator can get a deterrent effect for his actions. The research method used is the type of research which is empirical legal research using the Factual Approach and Empirical Sociological Approach with primary and secondary data sources, which are collected using observation, interview techniques and documentation techniques. The results of the study show that the investigation into the perpetrators of the crime of aggravated motorcycle theft in the jurisdiction of the North Kuta Police, Badung Police was carried out by following a legal mechanism that began with the receipt of the report, stages, the investigation process, namely, and the stage of determining the direction of the case. In the process, investigators attempted to collect evidence to fulfill the elements of Article 477 of the Republic of Indonesia Law Number 1 of 2023 concerning the Criminal Code. Obstacles in the investigation process are caused by law enforcement factors related to the lack of/minimal capacity of law enforcement, as well as community factors related to a lack of vigilance, participation, and support. To overcome these obstacles, preventive and repressive efforts have been implemented.
