Abstract

Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography is an international agreement to fight child pornography. The perpetrators use children as players in pornographic videos created in their pornography industry. The video is sold to sexual predator. The video is created by an international network syndicate. In this study there are two issues discussed namely the criminalization of child pornography in national law and child protection from sexual exploitation in industry. Criminalization of child pornography in national law can be seen in Article 282 of the Criminal Code, Act of the Republic of Indonesia Number 44 of 2008 on Pornography, Act Number 11 of 2008 on Information and Electronic Transactions. Child protection from sexual exploitation in the pornography industry is done by sanctioning criminal sanctions by adding 1/3 of the principal penalty

Ni Luh Gede Yogi Arthani, Fakultas Hukum Universitas Mahasaraswati Denpasar

Born in Denpasar, December 22, 1980. She completed her undergraduate education at the Faculty of Law at Udayana University and S2 at the Udayana University Law Masters Program. Currently working as a lecturer at the Faculty of Law, Mahasaraswati University, Denpasar. She served as Deputy Dean III of the Faculty of Law, Mahasaraswati University, Denpasar. Some of the subjects included include health law, sociology, legal sociology, legal anthropology, criminology and commercial law. Active in community service activities.
